Up until 1992, buying real estate along Mexico’s coastline was virtually impossible. Now, thanks to the North American Free Trade Agreement, a growing population of 1.5 million Americans owns property in Mexico. As a foreign buyer, rights of ownership are obtained via the establishment of a bank trust (known as a Fideicomiso), which is similar to a U.S. family trust. Technically, the purchaser is the trust beneficiary and, as such, is allowed to use, lease, sell, will and improve the property. The trust must be established for 50 years and is easily renewable for another term.
